FestAdmin Terms of Service

Drofmada Ltd ("we", "our", "us"), trading as FestAdmin, provides festival management software and services. These Terms of Service set out the rules and responsibilities for using our platform.

These terms apply to two different types of users:

  • Festival Organisers (festivals who pay for our services to manage their events)
  • Participants (people who register for festivals through our platform)

By using FestAdmin, you agree to these terms. If you do not agree, please do not use our services.

Section A – Festival Organisers

If you are a festival using FestAdmin to manage your events:

Our Services

  • Class and category management
  • Participant registration and booking system
  • Donation processing system
  • Payment processing integration (via Stripe)
  • Digital syllabus generation
  • Festival website hosting
  • Administrative tools and reporting

What's Not Included

  • DNS or domain hosting (available as an extra service)
  • Full technical support (available as an extra service)
  • Custom development work

Pricing and Payment

  • We charge annually for our services
  • Pricing changes will be notified 90 days in advance
  • Payment is due on the anniversary of your subscription
  • If payment is not received, your account may be suspended
  • Data will be preserved for up to 1 year after suspension

Your Responsibilities

  • Data Controller: You are the data controller for all participant data. You must comply with UK GDPR and have your own privacy policy.
  • Data Processor: FestAdmin acts as a data processor for participant data and will only process such data on your documented instructions, in line with UK GDPR Article 28.
  • Legal Compliance: You must comply with all UK laws and regulations.
  • Charity Registration: If you accept donations, you are responsible for ensuring compliance with UK charity law, including any required charity registration, Gift Aid eligibility, and tax receipt obligations.
  • Content Moderation: You are responsible for all content you upload.
  • Copyright: You are responsible for ensuring your content does not infringe third-party rights.
  • Participant Disputes: You handle all disputes with participants directly.
  • Refunds: You are responsible for all refunds to participants and donors, subject to your own refund policy and applicable law.
  • Age Restrictions: You must ensure that participants under 18 are registered by a parent, guardian, or another responsible adult with parental consent (for example, a teacher).

Data Ownership and Export

  • You own all your festival data
  • We provide data export tools to help you manage your festival
  • We claim no rights to your festival data
  • You may export your data and leave our platform at any time

Service Levels

  • Uptime: We use reasonable endeavours to maintain service availability
  • Support: 48-hour response time for basic support
  • Additional Support: Available for additional fees
  • Maintenance: Planned outside UK business hours and away from festival dates where possible

Section B – Festival Participants

If you are registering for a festival through our platform:

Important: Who Is Responsible

The festival you are registering with is responsible for your booking and for your personal data, not FestAdmin.

FestAdmin only provides the technical platform. The festival decides how your data is used, sets its own rules, and is the contracting party for your entry.

For any questions about your booking, refunds, or personal data, please contact the festival directly.

Age Requirements

  • You must be 18 or over to register yourself on the platform.
  • If you are under 18, your registration must be completed by a parent, guardian, or another responsible adult with parental consent (for example, a teacher). We do not verify ages and rely on organisers and families to comply with this rule.

Your Responsibilities

  • Provide accurate and complete information when registering.
  • Follow the festival’s rules, requirements, and policies.
  • Contact the festival directly if you have any issues or disputes about your entry.

Payments and Refunds

  • Payments are processed securely by Stripe into the festival's own Stripe account.
  • FestAdmin never owns, receives, or transfers the funds and does not hold or process your card details.
  • Refunds, cancellations, chargebacks, and all payment disputes must be handled directly with the festival.
  • FestAdmin is not a party to your contract with the festival.

Donations

Donations are voluntary contributions to support the festival.

Donations are separate from bookings and entries, and are processed through the same secure Stripe payment system.

  • Non-Refundable: Donations are generally non-refundable. Refunds may only be available in exceptional circumstances (e.g., processing errors) and must be requested directly from the festival within 14 days of the donation date.
  • Tax Implications: The festival is responsible for all tax, charity registration, and Gift Aid compliance. FestAdmin is not responsible for tax receipts, charity status verification, or Gift Aid claims.
  • Charity Status: If you make a donation, the festival is responsible for ensuring compliance with UK charity law. FestAdmin does not verify or guarantee a festival's charity status or registration.
  • Payment Processing: Donations are processed securely by Stripe directly into the festival's Stripe account. FestAdmin never receives, holds, or transfers donation funds.
  • No Guarantees: Donations are voluntary contributions. The festival is not obligated to provide any goods, services, or benefits in exchange for donations unless explicitly stated by the festival.
  • Disputes: All donation-related disputes, including refund requests, must be handled directly with the festival. FestAdmin is not a party to donation transactions and cannot process refunds or resolve disputes.
  • Minimum and Maximum Amounts: Donations are subject to minimum and maximum amounts as set by the festival. These limits are displayed on the donation form.

How to Register (Consumer Information)

  • To register, you will complete the online form and confirm your entry by clicking the final “Submit” button.
  • Before submitting, you can review and correct your information on screen.
  • A confirmation message will be shown on screen and/or emailed to you.
  • FestAdmin does not store or provide a copy of your registration contract – please keep your own records.

Nothing in these terms affects your statutory rights as a consumer under UK law.

  • Stable internet connection
  • JavaScript enabled for full functionality

API Terms

We may offer API access for platform integrations and data access.

  • Free for public, non-commercial, and light commercial use.
  • Subject to fair-use limits.
  • Contact us for higher-volume or guaranteed access.
  • Do not use the API in a way that harms, degrades, or overloads our services.
  • Do not resell the data or use it for commercial aggregation without permission.
  • Please include clear attribution where applicable.
  • If you can, let us know briefly how you are using the API (optional).

Our Responsibilities and Limitations

What We Do

  • Provide reliable festival management software
  • Use reasonable endeavours to maintain service availability
  • Secure your data with industry-standard security measures
  • Provide data export tools
  • Moderate inappropriate content
  • Support the long-term sustainability of festivals by making management easier in a changing world

What We Don't Guarantee

  • Data Loss: We try our best but accept minimal liability for data loss
  • Service Downtime: No liability unless you pay for additional resilience
  • Third-Party Services: We are not responsible for Stripe, email, or other third-party outages
  • Festival Disputes: We do not get involved in disputes between festivals and participants

Security Measures

  • TLS/SSL encryption for all data transmission
  • Industry-standard security practices, including consideration of the OWASP Top 10
  • Strong password requirements
  • Two-factor authentication (coming soon)
  • Regular security updates and monitoring

Limitation of Liability

To the fullest extent permitted by law, our total liability to you under these terms, whether in contract, tort (including negligence) or otherwise, shall be limited to the total fees you have paid to us in the 12 months preceding the claim. We do not exclude or limit liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

Termination

We may terminate your account if you:

  • Do not pay your subscription fees
  • Abuse our platform or services
  • Post defamatory or inappropriate content
  • Violate UK law
  • Engage in conduct that materially disrupts, damages, or risks the security or integrity of our services

We will give you 30 days' notice before termination (except in cases of serious violations).

Data Retention

  • We may retain your data for up to 6 years as required by UK law
  • After 6 years, we reserve the right to delete all data
  • You may request data deletion at any time
  • We provide data export tools to help you move your data

Dispute Resolution

If you have a dispute with us:

  • Please first try to resolve it directly with us
  • If unresolved, we may suggest mediation with an agreed third party
  • We aim to resolve issues amicably wherever possible
  • These terms are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction

Force Majeure

We are not liable for delays or failures caused by:

  • Major cloud provider outages
  • Natural disasters
  • UK-wide internet outages
  • Government actions
  • Other events beyond our reasonable control

We will use reasonable endeavours to restore service within 48 hours of major outages.

Changes to These Terms

We may update these terms from time to time. We will notify you of significant changes:

  • Festival organisers: 90 days' notice for pricing changes
  • All users: 30 days' notice for other significant changes
  • Minor changes: Posted on our website

Continued use of our services means you accept the updated terms.
